How does expungement work in Virginia?

Have you been convicted of a first offense DUI or even a second offense? If so, you may be wondering, “How does expungement work in Virginia?” and, “Can I get my DUI conviction expunged from my record?”

Virginia takes its DUI laws very seriously. The state is quick to prosecute and quick to deliver the consequences of a DUI conviction. They’re so quick, in fact, that state law stipulates that anyone arrested on suspicion (not even convicted) of DUI see his or her driver’s license suspended for seven days.

It is possible to get your DUI conviction expunged—removed--from your record, but it’s not easy.

You’ll have to file a petition for expungement in the proper circuit court, which must then approved. The petition requires a copy of the warrants or indictments of the charge(s) you want expunged. You’ll also have to submit your fingerprints with the petition to the state’s Central Criminal Record Exchange (CCRE).

The next step is a court hearing that will decide whether or not to have your charges expunged. If you’re successful, then your DUI charges will be sealed from your permanent criminal record, meaning that no one can see your record other than governmental entities and other authorities.

The good news is that this means you do not have to reveal your DUI charges to colleges, landlords or employers.
