In Virginia, there are two types of divorce: divorce from the bond of matrimony (a vinculo matimonii) & divorce from bed and board (a mensa et thoro). Both are technically considered as separate decrees, but after expiration of the statutory time period, the two can be merged into a single divorce from the bond of matrimony.

In basic terms, a legal separation is necessary for a divorce unless your spouse has either been convicted of a crime or you can prove they have been unfaithful to the marriage (adultery, sodomy, or buggery).  Legal separation agreements in Virginia are binding.

Grounds for a Legal Separation in Virginia

There are two main grounds for a divorce from bed and board (legal separation agreement):
 
  • Willful Desertion or Abandonment: Breaking off cohabitation with the intent to desert the marriage is grounds for a legal separation in Virginia.
  • Cruelty & Reasonable Apprehension of Bodily Harm: Fear for your safety, either from physical abuse or from severe mental or emotional abuse.
